The holdover clause, explained accurately

The holdover clause is one of the most misunderstood parts of a listing agreement. It’s designed to prevent a seller from working with a buyer the brokerage introduced during the listing period, then waiting until the agreement expires to complete the sale without paying commission. If a buyer who was shown the property or otherwise introduced during the listing period ends up purchasing it within the holdover window after expiry, commission is typically still owed.

What often gets misstated is the length of this window — there’s no standard, legally fixed holdover period. It’s a blank on the standard form that the seller and brokerage fill in together, and if it’s left blank, it generally means no holdover period applies at all. Commonly discussed ranges fall somewhere between 60 and 90 days, but the actual number in any specific agreement is whatever was negotiated and written in — which makes it worth reading closely rather than assuming a standard length.

How long should a listing agreement last?

Like the holdover period, there’s no fixed or standard term length required by law — this is negotiated between the seller and brokerage based on the specific home and circumstances. Factors that reasonably affect the right term include how quickly comparable homes are currently selling — current Ottawa Real Estate Board statistics are a useful reference point — whether the property is unique or higher-priced and may need more market exposure time, and the season. A term that’s too short can force a renewal negotiation mid-process; one that’s too long can leave a seller locked in if the relationship isn’t working well.
